How Did Sutherland Not Pay Overtime Correctly?

The law requires that employees be paid for all time they are permitted to work. Our investigation has shown that Sutherland failed to pay proper overtime for the hours they permitted employees to work through a variety of means, including the following:
  • Making automatic time deductions for lunch breaks even when employees worked through all or part of their lunch period.

  • Failing to pay employees for time spent performing work duties before the start of their regularly scheduled shift; and

  • Improperly failing to include commissions and bonuses in calculating pay for overtime purposes.

The law requires that hourly employees receive time and a half for all hours they work over forty in a week.

What Are The Primary Goals Of This Potential Lawsuit?
Our primary goals in this collective action are to:

  • Recover unpaid wages and overtime and other damages for employees who were not properly paid for the time they worked.

  • Prohibit Sutherland from engaging in future illegal conduct under the wage laws.

  • Have Sutherland set aside money to properly pay wages and overtime in the future.
